KVKK Privacy Notice and Explicit Consent

This notice is the English counterpart of the Turkish KVKK Aydınlatma ve Açık Rıza Metni. It is provided for information; if the two versions differ, the Turkish version prevails. It covers the personal data of people who subscribe to the Yellow Law newsletter on the Turkish version of yellow.law, under Turkish Personal Data Protection Law No. 6698 ("KVKK"). Our Privacy Policy applies in addition.

Part A — Privacy notice (KVKK Article 10)

2. Personal data we process

• Identity: first and last name.
• Contact: email address.
• Marketing: the topics you select, your language preference, and your interactions with our emails (deliveries, opens, clicks, unsubscribes).
• Transaction security: IP address, the date and time of your consents, the version of the consent text you accepted, and spam-protection signals.
• Visit source: how you reached the site (for example a search engine or a campaign link) on the visit you subscribed.

3. Purposes

• Sending the newsletter and informational emails on the topics you choose;
• Sending webinar and event invitations, if you select that topic;
• Keeping a record of your subscription and consents, and proving them when needed;
• Measuring how our emails perform and improving their content;
• Preventing spam and abuse of our forms, and keeping our systems secure;
• Meeting our legal obligations and responding to requests from authorities.

4. Legal grounds

We send the newsletter and transfer your data abroad for that purpose on the basis of your explicit consent (KVKK Articles 5(1) and 9). We keep consent and opt-out records because processing is necessary to establish, exercise or defend a right (Article 5(2)(e)) and to comply with legal obligations (Article 5(2)(ç)). Security and spam-prevention processing relies on our legitimate interests (Article 5(2)(f)).

5. How we collect it

Electronically and by automated means, through the newsletter form on yellow.law and the email platform we use to send the newsletter.

6. Who we share it with, and transfers abroad

Yellow Law is based in the United States, so your data is processed in the United States. We share it only with service providers that work for us, for the purposes above: HubSpot, Inc. (contact management and email sending), Resend (internal notification emails), Cloudflare, Inc. (spam protection), and our hosting provider. Transfers abroad are made under the mechanisms set out in KVKK Article 9. We do not sell your personal data. We may disclose it to public authorities when the law requires it.

7. How long we keep it

For as long as you are subscribed. After you unsubscribe or withdraw your consent, we stop sending emails right away and keep only the record of your consent and opt-out, for three years, to be able to prove them; then we delete or anonymise it.

8. Your rights (KVKK Article 11)

You have the right to: learn whether your personal data is processed; request information about it; learn the purpose of the processing and whether the data is used for that purpose; know the third parties in Turkey or abroad to whom it is transferred; ask for incomplete or inaccurate data to be corrected; ask for it to be erased or destroyed under KVKK Article 7; ask that corrections and erasures be notified to the third parties it was transferred to; object to a result against you that arises solely from automated analysis; and claim compensation for damage caused by unlawful processing.

9. How to apply

Send your request in writing to the address above, or by email to contact@yellow.law from the email address you subscribed with. We answer free of charge within 30 days at the latest. You can stop the newsletter at any time with the "unsubscribe" link in every email.

Part B — Explicit consent statement

By ticking the KVKK box on the Turkish newsletter form, you declare that:

I have read and understood the Privacy Notice above. Of my own free will, I give my explicit consent to Yellow Law Group, PC processing my first and last name, email address, language preference and the topics I select, in order to send me the newsletter and informational emails, and to these data being transferred for that purpose to its service providers located in the United States, including HubSpot, Inc. I can withdraw my consent at any time through the "unsubscribe" link in any email or by writing to contact@yellow.law; withdrawal does not affect processing carried out before it.
